Terms of Service

Effective October 28, 2026

In short: These terms cover your use of this website. Any project we take on is governed by its own written agreement. The website is provided as is, third-party platforms and services are the responsibility of the companies that run them, and our liability is limited, as explained under “No warranties” and “Limitation of liability.” Florida law applies. If you have questions, email hello@signaturewebsite.com.

1. About these terms

These Terms of Service (“terms”) apply to your use of signaturewebsite.com (the “website”), which is run by Signature (“Signature,” “we,” “us”). By using the website or sending us a brief, you agree to these terms. If you don’t agree, please don’t use the website. Our Privacy Policy explains how we handle personal information.

2. Who can use the website

Anyone may browse the website. You must be at least 18 years old to send us a brief or hire us. If you send a brief or hire us on behalf of a business, you confirm that you’re authorized to act for it, and “you” includes that business.

3. Using the website

You may use the website to learn about our services and to contact us. Please don’t:

  • use it in a way that breaks the law or harms others;
  • send false, misleading or spam briefs, or content that infringes anyone’s rights;
  • try to interfere with, overload or gain unauthorized access to the website or its systems;
  • scrape, copy or reuse large parts of the website for your own commercial purposes.

We may change, suspend or stop any part of the website at any time, and we may decline any brief or project.

4. Our content and intellectual property

The website’s design, text, graphics and the Signature name and mark belong to us or are used with permission, and are protected by intellectual property laws. You may view the website and share links to it, but you may not copy or reuse its content for another purpose without our written permission.

Websites shown in our portfolio belong to their owners. We show them as examples of our work. Names of other companies, platforms and products mentioned on the website, such as Wix or WordPress, are trademarks of their owners. Mentioning them doesn’t mean they endorse us or that we’re affiliated with them.

Copyright concerns. If you believe something on this website infringes your copyright, email hello@signaturewebsite.com with: a description of the work; where the material appears on our website; your name and contact details; a statement that you believe in good faith the use isn’t authorized; and a statement, under penalty of perjury, that your notice is accurate and that you own the copyright or are authorized to act for the owner, with your physical or electronic signature. We’ll review it and remove material where appropriate.

5. Briefs and messages you send

When you send us a brief or message, please make sure the information is accurate and that you have the right to share it, and please don’t include passwords, payment details or other sensitive information. Sending a brief doesn’t create a contract or oblige either of us to work together. A quote or estimate isn’t binding until we both sign a written project agreement.

We keep briefs private, as described in our Privacy Policy, but sending a brief doesn’t create a confidentiality agreement. We work with many businesses and may already be working on, or later create, designs or ideas similar to yours for others. If you need a confidentiality agreement before sharing details, ask us first.

6. Client projects

If we agree to work together, the project is governed by a separate written proposal or agreement (“project agreement”) that sets out its scope, schedule, price and terms. If the project agreement conflicts with these terms, the project agreement controls. Where the project agreement doesn’t cover something, the sections of these terms on your content, third-party services, warranties and liability also apply to the project.

Descriptions on this website, in our emails, and in conversations before a project agreement is signed describe our typical work. That includes how quickly we launch websites or reply, what’s included, and how fast a site loads. They’re not a promise or guarantee for any particular project. Your project’s details are the ones in its project agreement. We don’t promise any particular business results, such as search rankings, traffic, leads or sales.

7. Your content and responsibilities

When you work with us, you’re responsible for the content and materials you provide, including text, images, logos, videos, data and access to accounts. You confirm that you have the rights to use them, that they’re accurate and lawful, and that our use of them for your project won’t infringe anyone’s rights.

Unless your project agreement says otherwise, you’re also responsible for:

  • reviewing and approving your website and its content before it goes live;
  • your own website’s and business’s legal compliance, including privacy notices, cookie and consent requirements, accessibility obligations, consumer protection rules and any rules specific to your industry;
  • keeping your own backups of your website, content and data;
  • the security of your accounts, including removing our access and changing any passwords you shared with us when a project ends.

8. Third-party platforms and services

Many websites rely on services run by other companies, such as website platforms (for example Wix, WordPress or Shopify), hosting, domain registration, plugins, themes, fonts, payment processors, email and analytics tools. Those services are governed by their providers’ own terms and policies, which you’re responsible for accepting and following.

We don’t control third-party services and aren’t responsible for their availability, changes, updates, pricing, security, data handling, or any loss or damage they cause. Any fees they charge are your responsibility. Work needed because a third-party service changes or fails isn’t included, unless your project agreement says otherwise.

The website links to other websites, including those in our portfolio. We don’t run them and aren’t responsible for their content or practices.

9. No warranties

The website and everything on it are provided “as is” and “as available.” To the maximum extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t promise that the website or its content will be accurate, complete, always available, secure, or free of errors or harmful components. Any warranties for a client project are only those stated in its project agreement.

10. Limitation of liability

To the maximum extent the law allows:

  • we aren’t liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunities, even if we were told they were possible;
  • for any claim relating to a client project, our total liability is limited to the fees you paid us for that project (or, for ongoing services, the fees you paid us for them in the 12 months before the claim);
  • for any claim relating only to your use of this website, our total liability is limited to US $100.

These limits apply to all claims, whether based on contract, warranty, tort (including negligence), strict liability or any other legal theory, and even if a remedy fails of its essential purpose. They don’t limit liability for fraud, intentional misconduct, or anything else that can’t be limited by law. If your project agreement sets different limits, that agreement controls.

11. Indemnification

You agree to defend, indemnify and hold harmless Signature and its owners, employees and contractors from any claims brought by third parties, and the resulting losses, damages and costs (including reasonable attorneys’ fees), arising from content or materials you provide, your use of the website in breach of these terms, or your violation of any law or anyone else’s rights. We’ll tell you about any such claim, and we may take part in the defense with a lawyer of our choice.

12. Disputes and governing law

Talk to us first. If you have a dispute with us about these terms or the website, email hello@signaturewebsite.com and describe it. We’ll both try in good faith to resolve it within 30 days before either of us starts a lawsuit, except for urgent requests to a court to stop misuse of the website or of intellectual property.

Governing law and courts. These terms, and any dispute about them or the website, are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any lawsuit about these terms or the website must be brought only in the state courts located in Miami-Dade County, Florida, or in the United States District Court for the Southern District of Florida, and you and we consent to those courts’ personal jurisdiction and venue.

Jury trial waiver. To the extent the law allows, you and we each give up the right to a trial by jury in any lawsuit about these terms or the website.

13. Changes to these terms

We may update these terms from time to time. We’ll post the new version here and update the effective date at the top. Changes apply from that date to your use of the website and to briefs you send afterward. They don’t apply to a dispute that arose before the change.

14. General

  • Whole agreement. These terms are the whole agreement between you and us about using the website. A project agreement governs any project, as described in “Client projects.”
  • If part doesn’t apply. If any part of these terms is found unenforceable, it will be enforced to the maximum extent allowed, and the rest still applies.
  • No waiver. If we don’t enforce a part of these terms right away, we can still enforce it later.
  • Transfer. You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours, for example if we sell or reorganize our business.
  • Events beyond our control. We aren’t responsible for delays or failures caused by events beyond our reasonable control, such as hurricanes and other natural disasters, power or internet outages, failures of hosting or other third-party services, cyberattacks, or government actions.
  • Electronic communications. You agree that we can communicate with you electronically, including by email, and that electronic notices meet any requirement for written notice. Notices to us go to hello@signaturewebsite.com.
  • Survival. Sections that by their nature should continue after you stop using the website continue, including intellectual property, no warranties, limitation of liability, indemnification, and disputes and governing law.
